Damages Recoverable in a Slip and Fall or Premises Liability Claim

Florida law allows persons injured in slip and fall accidents or other types of premises liability claims to recover generally the same types of damages recoverable in an auto accident case.  Unlike an auto accident case, however, the injured party does not have access to No Fault insurance that pays regardless of fault for the accident.  This means that in a slip and fall or other premises liability accident, you must prove negligence or fault on the part of the owner of the property or business where your accident occurred you are entitled to the recovery of any damages.

If the owner or operator of the premises can be proven to have been at fault, an injured party is allowed to seek to recover medical bills and lost wages resulting from the accident, both since the date of the accident and into the future.  While an injured party involved in an auto accident must prove the existence of a permanent injury in order to recover damages for their pain and suffering caused by their accident, someone injured in a slip and fall or other premises liability claim does not have to prove that their injuries are permanent before recovering damages for pain and suffering.
